Global Finance and Services Ltda., registered with the CNPJ under no. 12.222.945/0001-37, is located at Av. Luiz Paulo Franco, no. 603, 4th floor, belvedere, Belo Horizonte, Minas Gerais, CEP 30320-570 (“Global Finanças”), establishes in these Terms and Conditions of Use of the Website, through which the User and/or Customer may access the services and content made available by Global Finance, in order to clarify the obligations and responsibilities of its Users and/or Customers.
For the purposes of these Terms and Conditions of Use, the following shall be considered:
1.1. Website: means the website through which the User accesses the services and content made available by Global Finance.
1.2. Password: set of characters that may consist of letters and/or numbers, for the purpose of verifying the User’s identity to access the Website.
1.3. Terminals (or “Terminal”, when considered individually): computers, notebooks, netbooks, smartphones, tablets and any other devices that connect to the Internet.
1.4. Users or Customers (or “User”, when considered individually): all natural persons who will use the Website and who have full civil capacity.
By accessing the Website, the User/Customer fully agrees and accepts the provisions of these Terms and Conditions of Use.
The User is aware that, in order to access the content and/or services made available by the Website, it may be necessary to register on the Website, by creating a profile with a login and password, as well as providing some personal registration data , such as: full name, address, e-mail, CPF (“Registration Data”). Other Registration Data for identification of the User and/or access to the Website may be requested, if necessary for identification of the User and/or for the User to access the content and/or services of the Website.
3.1. The User is responsible for the accuracy and veracity of the data provided and acknowledges that any inconsistency in such data may make it impossible to access and/or use the Website.
3.2. The User assumes full responsibility for the safekeeping, confidentiality and proper use of the registered login and passwords, exempting Global Finance from any liability in this regard.
3.3. The login and password may only be used by the registered User, and sharing the login and/or password with any third parties is expressly prohibited.
3.4. The User may, at any time, delete his/her account on the Website, except for the safeguarding by Global Finances of the information and/or data whose maintenance is imposed on it due to legal and/or regulatory obligations or, furthermore, whose maintenance is necessary to comply with a court order, within the scope of judicial and/or administrative proceedings and questioning by third parties, arising from the processing carried out by the User on the Website.
The User is aware of and agrees to the collection, storage, treatment, processing and use of the information sent and/or transmitted by the User under the terms established in these Terms and Conditions of Use. The User’s information will be collected, stored, processed and used by Global Finanças or by third parties authorized by the same for the exclusive purpose of the services and functionalities through the Website. Global Finanças may provide the user’s data and information upon legal, administrative or judicial determination.
By accepting these Terms of Use, the User agrees and authorizes the Website to collect, use and store this data and documents to perform credit assessments, confirm the veracity of the information provided and for other uses necessary to provide the products and services offered. Therefore, by providing his/her Individual Taxpayer Registration Number (CPF) and/or Legal Entity Registration Number (CNPJ), the User authorizes the Website, on his/her behalf, to exclusively authorize the institutions and/or entities that are partners of Global Finanças, on an irrevocable and irreversible basis, to consult the consolidated information about the User. The User also authorizes the consultation of his/her data with the Positive Registry, the purpose of which is to inform all financial transactions, credit history and payment behavior of obligations on behalf of the issuer. The User also authorizes consultations with other registration organizations (SERASA, SCI, SCPC and similar) regarding debt information, the purpose of which will be to share it with the contractors of said entities, which will be used to support credit and business decisions. The User is aware that Global Finanças may collect and store IP information, micro geolocation, date and time of visit, simulation and any record made by the user through the application or website. Additionally, the User authorizes Global Finanças to make telephone contacts with the User in order to collect other information necessary for credit analysis. And, finally, the User authorizes Global Finanças to send credit offers through any of the contact methods provided, such as, but not limited to, text messages (“SMS”), e-mail and push notifications.
The User is aware that, in order to use the Website, his/her Terminal must be logged into the Internet, which is the sole responsibility of the User and, therefore, is not responsible for any eventual impossibility of accessing, browsing and/or completing the contracting of services made available by the Website, as well as for any eventual losses, direct and/or indirect, of any nature, caused by failures, omissions, defects, interference by third parties, improper use of equipment, system failure, absence or weak Internet signal, among others, over which he/she has no control.
7.1. The User is aware and acknowledges that he/she may not commit any unlawful acts and/or acts in violation of the current legislation or these Terms and Conditions of Use through the use of the Website. In this sense, Global Finanças is not responsible, expressly or tacitly, for the improper use of the information, instruments, materials made available and/or any other functionality used and/or made available by the Website, for any purpose whatsoever, by any User, and the User shall be entirely responsible for any damages to his/her own rights or those of third parties caused by any improper use.
7.2. The User is exclusively responsible: (i) for any and all acts or omissions performed by him/her using his/her credentials when accessing the internet and the Website; (ii) for any and all content uploaded, sent and/or transmitted by him/her through the Website; and (iii) for the repair of any and all damages, direct or indirect (including those arising from the violation of any rights of other users, third parties, including intellectual property rights, confidentiality and personality rights), caused to Global Finanças, any other User, or any third party, including due to non-compliance with the provisions of these Terms and Conditions of Use or any act performed when accessing the internet and the Website.
7.3. Under no circumstances shall Global Finanças be liable: (i) for any act or omission performed and/or damage caused by the User resulting from access to the Website; (ii) for the improper use of the Website by any User or third parties and/or for the content uploaded, sent and/or transmitted through the Website by Users; (iii) for failures, technical impossibilities or unavailability of the system; (iv) for the installation on the User’s or third party’s Terminal of viruses, Trojans, malware, worms, bots, backdoors, spyware, rootkits, or any other devices that may be created as a result of the User’s internet browsing. The User is aware that it is prohibited to use the Website through non-human resources, such as, for example, through robots and other technological resources. The User is aware that the use of the Website does not guarantee the approval or contracting of credit. The User is aware that Global Finanças may use their data to identify financial products and solutions, however, it will never require any type of prior deposit for registration, fee, insurance or guarantee as a condition for products and solutions to its customers.
7.4. The User declares to be aware that any and all content sent and/or transmitted to the Website by any User and/or third parties does not represent, in any way, the opinion or view of Global Finanças.
7.5. If the User fails to comply with any provision of these Terms and Conditions of Use or legal provision, without prejudice to other measures, Global Finanças may, by itself or by third parties, at any time, at its sole discretion, without the need for any prior or subsequent warning or notification to any User or any third party, by any means or form, without prejudice to initiating the applicable legal measures, suspend or limit access to the Website, close the account (“access”) of any User and/or take other measures that it deems necessary for compliance with these Terms and Conditions of Use and for the proper functioning of the Website, at any time.
8.1. The following belong to Global Finanças: (i) any and all software, applications or functionality used by Global Finanças on the Website; (ii) the visual identity of the Website; (iii) the company name, brand, domain name, slogan or advertising expression or any distinctive sign of its ownership inserted on the Website; and (iv) any and all content created and produced by Global Finanças, by itself or by third parties, which may not be used, under any means or form, by Users.
8.2. In cases where the Website allows the User to send and/or transmit content (such as, for example, opinions and evaluations regarding the Website), the User grants free, non-exclusive, irrevocable and irreversible authorization to Global Finanças to use any and all intellectual property rights over any content sent and/or transmitted by the User to the Website, by any means or form, at its sole discretion, without any restriction or limitation of any nature. The User declares and guarantees that the content does not infringe the rights of third parties and that he/she has obtained all authorizations that may be necessary to enable the use thereof by Global Finanças.
Global Finanças, at any time, at its sole discretion and without the need for any prior or subsequent notice to any User or third party, may: (i) suspend, cancel or interrupt access to the Website; and (ii) remove, change and/or update the Website in whole or in part, as well as its respective contents and/or Terms and Conditions of Use. Any change and/or update of these Terms and Conditions of Use will come into effect from the date of its publication on the Website and must be fully observed by Users.
10.1. The Parties accept the evidentiary force, validity and effectiveness of electronic communications for all purposes and effects of these Terms and Conditions of Use.
10.2. Tolerance regarding any failure to comply with any of the provisions of these Terms and Conditions of Use by any User shall not constitute a waiver of the right to demand compliance with the obligation, nor forgiveness, nor alteration of what is provided herein.
10.3. The nullity of any provision of these Terms and Conditions of Use shall not affect the validity of the remaining provisions. If any provision of these Terms and Conditions of Use is annulled, declared void or unenforceable, in whole or in part, this document shall be deemed modified with the exclusion or modification, to the extent necessary, of the void, annulled or unenforceable provision, in order to preserve the Terms and Conditions of Use as valid and, to the extent possible, consistent with the original intention of the Parties.
This Term of Use has been defined in accordance with the Brazilian Civil Code, Consumer Protection Code and other complementary laws. Any disputes or controversies arising from any acts performed within the scope of the use of the Site by Users and/or Customers will be processed in the District of Belo Horizonte – MG.
